Terms and Conditions for Companionship and Friendship Services

These Terms and Conditions govern the provision of companionship and friendship services by Companions4U, trading as Companions4U, of 91 Holcroft Road, Southampton, SO19 6GZ (“we”, “us” or “the Provider”), to the person booking or receiving the services (“you” or “the Client”). By making or accepting a booking, you agree to these Terms. Nothing in these Terms affects your statutory consumer rights.

· The service offers social companionship, conversation and agreed activities such as walks, cafés, cultural visits, shopping assistance or attendance at community events.

· For these Terms, “Companion” means the individual engaged by the Provider to deliver the booked service.

· The service is platonic, non-romantic and non-sexual. No intimate, sexual, dating or matchmaking service is offered.

· Unless expressly agreed in writing and lawfully provided, the service does not include personal care, medical care, counselling, financial advice, legal advice, childcare, regulated transport, domestic work or handling the Client’s money.

· The exact activities, location, duration, accessibility requirements and any reasonable adjustments will be agreed before each booking.

We provide services only to clients aged 18 or over who are able to understand and agree to the service, with reasonable support where appropriate.

· A booking is confirmed only after we have issued written confirmation and received any required deposit or advance payment.

· Fees are £35.00 per hour, with a minimum booking of two hours, and are payable by PayPal at the time of booking.

· Unless stated otherwise, prices include any applicable taxes.

· The Client is solely responsible for all additional expenses and neither the business nor the companion will cover these costs. These expenses – including admission tickets, meals, beverages, parking, or agreed travel exceeding a 5-mile radius (round trip) from the client’s home- must be paid for by the Client at the time of the outing or via an agreed invoice. These costs will only be incurred if they have been disclosed in advance of the outing. Where an invoice is agreed, the receipts will be provided to the Client as proof of purchase

· Late payments may be handled in accordance with applicable law.

We will not impose unfair or undisclosed charges. Before you confirm a booking, we will clearly explain the total service fee, any deposit or advance payment required, the agreed travel radius, and any additional expenses that you may have to pay. We will obtain your agreement before incurring any optional additional cost on your behalf.

· You may cancel or reschedule by emailing bookings@companions4u.uk or calling 01329 722 101. Our standard cancellation notice period is 48 hours.

· For cancellations made with at least the standard notice, full refunds apply. For later cancellations or non-attendance, we will not refund any payment made for the affected booking.

· If we cancel, we will offer a suitable replacement booking or refund the affected service fee.

· Where a contract is concluded online, by telephone or away from our business premises, you may have a statutory right to cancel within 14 days. If you ask us to begin providing the service during that period, you will have to pay a proportionate amount for services supplied before cancellation. If the service is fully performed during that period following your prior express request and acknowledgement, the statutory right to cancel will end.

· Any refund due will be made without undue delay and within the time required by law, using the original payment method unless otherwise agreed.

· Everyone must behave lawfully, respectfully and without harassment, discrimination, intimidation, violence or abuse.

· Physical contact is limited to ordinary, consensual social gestures. Either person may refuse or withdraw consent to any contact or activity at any time.

· No person may bring illegal substances or weapons to a booking, attend while dangerously intoxicated, or request unlawful or unsafe conduct.

· The Client must provide a reasonably safe environment and disclose any known hazards before the booking. The Provider may leave or end a booking immediately if continuing would put anyone’s safety, dignity or professional boundaries at risk.

· In an emergency, we may contact emergency services and the Client’s nominated emergency contact. We are not an emergency, crisis or medical service.

· We may record and report a safeguarding concern to the appropriate authorities where required by law or where reasonably necessary to protect someone from harm.

We will treat personal information and conversations as confidential unless disclosure is required by law or reasonably necessary for safeguarding. We will process personal data in accordance with applicable UK data protection law and our Privacy Notice, available at www.companions4u.uk/privacy.

Our Privacy Notice explains what information we collect, why we use it, our lawful basis, who we share it with, how long we retain it, and how individuals may exercise their rights. We will use photos, recordings or testimonials only with appropriate permission.

We will provide the service with reasonable care and skill and are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for loss caused by inaccurate information supplied by the Client, risks outside our reasonable control, or activities undertaken contrary to agreed guidance. Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Either party may end an ongoing arrangement by giving 14 days’ written notice. We may suspend or terminate services immediately for non-payment, serious or repeated breach, unlawful requests, harassment, threats, unsafe conditions, safeguarding concerns or conduct that makes continued provision unreasonable. Fees remain payable for services properly supplied up to the date of termination, subject to applicable consumer law.

Please email your complaint to contact@companions4u.uk. We will acknowledge it within 7 working days of receipt and aim to provide a substantive response within 14 working days of receipt. If we cannot resolve the matter, we will provide details of any applicable alternative dispute resolution provider where required.

· Any change to a confirmed booking must be agreed by both parties. We may update these Terms for future bookings by giving reasonable notice. Updated Terms will not apply to a booking already confirmed unless both parties agree.

· If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.

· No person other than the Client and the Provider has rights under these Terms, except where the law provides otherwise.

· These Terms are governed by the law of England and Wales. The courts with jurisdiction under applicable consumer law may hear any dispute.
